Amos Foundation

The ATO's amended requirements for organisations with Deductible Gift Recipient status became effective 1 July 2000.  This had the effect of rendering the DFACI Foundation ineligible  In August 2003 DFACI resolved not to exercise its Foundation in favour of supporting a new foundation to be established by the Defence Force Board (DFB) of General Synod of the ACA.  After receiving legal advice, the DFB decided to establish the “The AMOS Foundation” (AMOS being derived from Anglican Military – Outreach and Service). It was created as a completely new foundation by a Deed of Trust dated 10 February 2004 between the DFB and the General Secretary of the ACA General Synod, the Reverend Dr Bruce Kaye, who also consented to act as Settlor of the Foundation. This Deed of Trust complies fully with current ATO requirements. 

Company Structure

In establishing the Foundation it was also necessary to set up a new company – the AMOS Company Pty Ltd – as a legal entity capable of acting as Trustee for the AMOS Foundation. All shares in AMOS Company Pty Ltd are held in bare trust for the DFB by DFACI, which is an incorporated body and therefore legally capable of owning property. DFACI is bound by a separate Trust Deed dated 6 December 2003 to act in all matters relating to those shares strictly and solely in accord with directions from the DFB.

Company Directors

The DFB has resolved that there will be four Directors of AMOS Company Pty Ltd. The Bishop to the ADF, as ex-officio chair of the DFB, will be a Director and Chairman of the Company. The Senior Archdeacon (determined by date of collation) will be a director. One clerical member and lay member of the DFB will be elected from within the DFB to serve as a director. 

As the Foundation exists to provide a capital fund, the company directors will be responsible for ensuring that the funds received are used in accordance with the AMOS Foundation Deed of Trust and in compliance with the provisions of the Income Tax Assessment Act 1997.

Constitution

A copy of the Foundation’s Trust Deed is available on request. The substantive objectives of the AMOS Foundation are to provide financial assistance:

  • for the comfort, welfare and education of members of the Australian Defence Force, particularly but not limited to members of the Anglican Church of Australia;

  • for the support of the Anglican Chaplains in the Defence Force to enable them to minister and provide support more effectively to members of the Defence Force and their families;
     

  • to enable the Bishop to the Defence Force to more effectively perform his ministry, and to perform his ministry on a full time basis; and,

  • to solicit donations, gifts, bequests and other forms of financial support, to invest and to use the same and the income derived therefrom for the purposes of the Foundation.

Targets

The foundation is seeking to raise a capital fund of $2.3 million. It will be used in four ways. 

The first is financing the establishment of a “Defence Force Chaplaincy Centre” in Canberra. It is estimated that the purchase of land in a suitable location will cost in the region of $300,000 while the construction of an architecturally designed building is estimated at $400,000.

The second is providing an annual subsidy of $50,000 for the maintenance of an office and secretarial support for the Bishop to the ADF. This will require investment capital of approximately $1 million.

The third is the vocational training of uniformed ADF members seeking to become chaplains. An annual sum of $20,000 will be made available for this purpose requiring an invested capital fund of $400,000.

The fourth is the provision of small welfare grants for chaplains and ordinands facing acute financial hardship owing to unforeseen family circumstances or emergencies. An annual sum of $10,000 will be made available for this purpose requiring an invested capital sum of $200,000.

His Excellency the Governor General of the Commonwealth of Australia, Major General Michael Jeffery AC CVO MC (Retd) is the Personal Patron-in-Chief of the Foundation.
